To Become A French Resident Or Not To Become One?

On September 4th I’ll be celebrating ten years in Paris. Exactly one month earlier on August 4th, I’ll be waiting my turn at the Préfecture de Police on the Ile de la Cité to apply for a Carte de Résident — a ten-year resident visa that will give me all the rights to live and work in France, but without citizenship privileges (the right to vote or carry a French passport). Certainly, I expect to be both anxiety-ridden and excited…worried if I have all the papers they require and all the right answers to their questions to qualify. (If legal advisor Jean Taquet weren’t on vacation in the U.S., he’d be there holding my hand.)

The paperwork is massive…every ounce of proof I can muster up that shows I lived here consecutively for ten years, own property here, educated a child here, paid tax here, etc., etc. As a gift, Jean gave me a stack of colored paper folders, one for each category of documents and said, “Now, let me see you fill them with the list I gave you and don’t leave out one single item.”

My daughter will be returning from New York mid October to do the same — exchange the temporary visa they afforded her this past winter for her permanent card. The visas will change our lives — fiscally since from a tax standpoint we’ll be officially domiciled in France and because at long last we’ll be able to pay into and take advantage of the French social security system. Goodbye private health insurance, hello Securité Sociale and a good “mutuelle” (additional coverage). The taxes will be higher, but the benefits greater.

Often I reflect on if I had to do it over again, would I ever have gotten the “Carte de Séjour” in the first place? — the visa that the “law” says you must have if you stay longer than 90 days. Like so many Expats, I could easily have lived in France “under the radar” — as long as I didn’t need to work and earn a living here, could take out affordable health insurance, own property, and so on…all the things one can do without that famous visa.

Too often, we Americans tend to “follow the law” because that’s what we believe we’re “supposed to do,” like “telling the truth” regardless of the negative consequences (like hurting someone’s feelings). When looking at the bigger picture, like the French seem to be able to do better, it’s sometimes more appropriate to do something else and the “law” can be considered more a “suggestion” of a way to live than something one must abide by just because it’s written that way. It’s a cultural difference that Expats wrestle with from the very beginning.

The question of visas and immigration is the number one and opening topic at every Living in France Conference we host. Jean Taquet, in his energetic and humorous style, makes a concerted effort to explain the “laws” of immigration vs the “reality” of it. Applying for a visa fits the dilemma of whether you should follow the “law” or consider it a “suggestion.” In a recent question from a reader, he explains:

Question: “Recently I have been offered a situation to stay with friends in France for six months. I would very much like to go. I have money in the bank and private health insurance. Can I stay for six months?”

Answer: “There is a legal answer and a very practical one.

The legal answer:

Considering the fact that you want to stay in France for more than three months, you should have a residency title of some sort. Would the request of an immigration visa and the request of a Carte de Séjour be the way to go, I am really not sure considering the short amount of time you intend to stay. Therefore the solution should be a non-immigration visa with multiple entries possible valid for the duration of your stay as long as it is for less than a year.

The practical answer:

Now all things considered and especially the fact that you will be staying at a friend’s house and be there living on your own money, you should seriously considering staying the said six months or so in France holding only your passport without any visa of some sort. This is very much a gray area in France since even though the law states this obligation to hold a visa or a residency title, no police officer wishes to enforce this law for people in this described situation.

My answer would be very different if there is even the smallest chance that you could stay on a more permanent basis.”

So, considering I came for one year and ended up staying ten, I guess in retrospect, it’s a good thing I followed the “law.”
