Finally, You are Entitled to Housing in Paris (for 10 Months or Less)!

The new Elan Laws created a “short-term mobility lease” for furnished accommodations, but the text that was voted on in the assembly won’t be approved until this coming fall. Until this new lease was proposed by Emmanuel Macron, the laws which govern short-term rentals in Paris actually eliminated the rights for anyone to have housing less than one-year (!), unless living in someone else’s primary residence! It never made sense to me or anyone with any logic, since there are many thousands of people who need housing in Paris for a variety of reasons for one month or more.

The text voted on in the assembly must still be confirmed in the final reading of the text in the autumn, but it deserves to be finalized. If you as a property owner have vacancies, this lease can be both a way to allow more people to find housing and a tool to fill the vacancy of your dwelling. As the occupancy is limited to 10 months, it does not commit you in the long term. In addition, the rental can benefit from the Garantie Visale – a deposit given to the tenant by Action Logement to cover the payment of rent and expenses of his principal residence, in case of unpaid bills. The sums are advanced to the lessor by Action Logement, then reimbursed by the tenant. (service-public.fr/particuliers/).
 
The mobility lease, technically speaking, is a short-term rental contract for a furnished dwelling within the meaning of Article 25-4 for a tenant who justifies, on the date of the taking effect of the lease, to be in vocational training, in higher education, in a learning contract, in internship, in a voluntary undertaking in the context of a civic service or on a temporary mission within the framework of his professional activity. Article 25-13 requires 13 mandatory mentions:

1. Name and domicile of the lessor and his representative
2. Name of the tenant
3. Effective Date
4. Lease term
5. Consistency, destination, habitable surface
6. Designation of premises and private equipment, where applicable, common equipment and information technology equipment
7. Amount of rent and terms of payment
8. Motive justifying the mobility lease (see what reason?)
9. Rent amount of the previous tenant (except in the case of vacancies exceeding 18 months)
10. Nature and amount of work done since the end of the last lease
11. Statement informing the tenant of the prohibition of the security deposit
12. Mention that the lease is governed by the title of the law of 1989 (failing that, it becomes a furnished lease of common law)
